1. Acceptance and scope
These draft Terms describe the intended agreement for access to AVENYQ's website and personal AI assistant. They must be approved and an appropriate acceptance process implemented before being treated as the final agreement. Once adopted, using the service will be subject to these Terms and applicable law. If you do not agree with the adopted Terms, do not use the service.
2. Eligibility and accounts
The proposed minimum age is 18, subject to founder and legal confirmation. You must be able to enter a binding agreement under applicable law. The current cloud beta also requires an invited account with a verified email. An invitation is not a promise of permanent access.
Provide accurate account information, secure your sign-in account and do not share access or impersonate another person. You are responsible for activity you authorise. Tell support promptly if you suspect unauthorised access.
3. Your responsibilities
Use AVENYQ lawfully and within published limits. You are responsible for the material you submit and your use of any output. Obtain the rights and permissions necessary to upload information, including information about other people. Do not submit credentials or unnecessary sensitive information.
4. AI responses and professional advice
AI-generated responses can contain errors, omissions, fabricated sources or outdated information. Verify important information against reliable sources before acting. Outputs may be similar to those provided to other users, and are not guaranteed to be original, complete or suitable for your purpose.
AVENYQ is not a replacement for qualified medical, legal, financial or other professional advice. Do not rely on it for emergencies or as the sole basis for decisions that could seriously affect a person's rights, health, safety or finances. You remain responsible for reviewing and deciding how to use the output.
5. Your content and processing permission
You retain any rights you hold in material you submit. To operate the service, you grant AVENYQ permission to host, copy, transmit, process and display that material, and to use service providers for those purposes. This permission is limited to providing and maintaining the service and meeting applicable obligations; it does not transfer ownership of your content.
Rights in AI output depend on applicable law and the relevant provider's terms. These Terms do not promise exclusive ownership, copyright protection or non-infringement of generated content. Training and improvement practices are described separately in the Privacy Policy and are not established by this operational licence.
6. AVENYQ intellectual property
The AVENYQ name, branding, interface and software are protected by applicable intellectual-property rights held by their respective owners. Access permits use of the service as offered, not ownership of its branding or software. Third-party and open-source materials remain subject to their applicable licences.
7. Prohibited use
Do not use AVENYQ for unlawful activity, fraud, exploitation, harassment, infringement, malware, unauthorised access or automated abuse. Do not bypass access controls, quotas or security measures, or interfere with other users or the infrastructure.
8. Third-party services
AVENYQ relies on external authentication, storage, AI and other services. Features may send information to those services as described in the Privacy Policy. Third-party terms may apply to their services. Linked websites and external content are not controlled or endorsed merely because an AI response includes them.
9. Availability and beta features
AVENYQ is under development. Features, supported models and usage limits may change, fail or be unavailable. Experimental output and saved work may be incomplete. Keep your own copies of important work. No uninterrupted availability, response time or service-level commitment is offered in this draft.
10. Future paid services
Paid subscriptions and planned model tiers are not currently available to purchase. Prices and plan descriptions are proposed offerings, not an active checkout or commitment to supply those features.
Before paid signup is enabled, the applicable billing frequency, automatic renewal, cancellation process, refund policy, taxes and usage limits must be disclosed and agreed. Those terms have not been finalised, and this draft does not invent a refund rule or authorise recurring charges.
11. Suspension and termination
Access may be restricted or ended for misuse, security concerns, legal requirements or changes to the beta. Where appropriate, notice and information about available data controls should be provided. You can stop using the service at any time; signing out does not delete your account. Request account closure through the privacy contact.
12. Disclaimers and liability
To the extent permitted by applicable law, the beta is provided as available without warranties of accuracy, fitness for a particular purpose or uninterrupted operation. AVENYQ is not responsible for decisions made solely in reliance on unverified AI output.
To the extent permitted by applicable law, AVENYQ excludes liability for indirect or consequential losses arising from use of the service. Nothing excludes liability that cannot legally be excluded or limits mandatory consumer rights. Any monetary liability cap and jurisdiction-specific provisions remain subject to legal review; no cap is proposed here.
13. Governing law
The operating entity, governing law and dispute-resolution forum have not yet been confirmed. These provisions must be completed before the Terms are adopted. No jurisdiction, arbitration requirement or waiver of statutory rights is implied by this draft.
14. Updates and contact
The date above identifies the current draft. Material revisions should be communicated with appropriate notice and acceptance where required. Contact support with questions about the service or these Terms.
